Welcome to Subs Market. These Terms of Service ("Terms") govern your use of our website and services. By accessing and using our platform, you confirm that you have read, understood, and agree to these Terms.

Subs Market is an online platform for sharing subscriptions between buyers and sellers. Our services include listing management, payment processing via Stripe, and access verification.

If you do not agree with these Terms, please do not use our platform. Your continued use of the platform constitutes your direct acceptance of these Terms.

To use our platform, you must create an account. By registering, you agree to the following:

• You will provide us with true, accurate, current, and complete information
• You are responsible for the security of your password and will notify us promptly of any unauthorized access
• You are responsible for all activities carried out under your account
• You must be at least 18 years old and legally capable of entering into contracts

You agree to use our platform only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use.

• You will not use the platform for any illegal or unauthorized purpose
• You will respect the intellectual property and rights of other users
• You will provide accurate and truthful information in all listings and profiles
• You will not engage in harassment, threats, or stalking of other users
• You will maintain proper and respectful conduct toward all platform users

The following content and behaviour is explicitly prohibited:

• Fraudulent listings or deceiving other users
• Sharing login credentials outside the scope of the offered service
• Selling illegal content or infringing copyrights
• Automated downloading or scraping of data from our platform
• Violating the terms of the services you share through the platform
• Any abuse or attack on our platform infrastructure

If you make payments or receive payouts on our platform, you agree to the following:

• All payments are processed via Stripe and are subject to Stripe's Terms of Service
• Buyer funds are held in escrow and released gradually
• We charge a 10% service fee on all seller transactions
• Service fees are non-refundable
• All prices are in Euros (EUR)

LIMITATION OF LIABILITY:

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform.

Our total liability to you for any claims arising out of or related to these Terms shall not exceed the amount you have paid through our platform in the last 12 months.

If you have a dispute with another user:

• Report the issue through our dispute resolution system
• We will conduct an investigation and gather evidence
• We will make a decision based on available evidence
• You may submit an appeal if you believe the decision was incorrect

All decisions issued by our platform are binding on both parties. You agree to resolve disputes in this manner.

We reserve the right to amend or update these Terms at any time. We will notify you of material changes via email or by posting on the platform.

If you read the updated Terms and continue using the platform, this constitutes your acceptance of the changes.

All content, features, and functionality of our platform, including text, graphics, logos, and icons, are the property of Subs Market or its licensors.

• We own or hold a licence to all intellectual property rights on our website
• We grant you a limited, non-commercial licence to use the platform
• You may not reproduce, distribute, or sell any content without our permission
• All content published by a user remains the property of that user

Our platform integrates third-party services such as Stripe, Apify, and Supabase. By using our platform, you agree to their terms.

We are not responsible for the content, privacy policies, or practices of these third parties. We recommend reading their terms and privacy policies.

DISCLAIMER:

Our services are provided "as is" and "as available" without any warranties. We expressly disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

These Terms are governed by and construed in accordance with the laws of the Czech Republic.

You agree to resolve all disputes arising from or in connection with these Terms exclusively in courts with jurisdiction in the Czech Republic.
